A Perth court has granted a bail variation to Rajwinder Singh Grewal, the rideshare driver accused of causing a crash that killed a seven-month-old baby, allowing him to work as a freight driver under strict conditions.
It is reported that Grewal, 35, appeared in Armadale Court on Monday, where he was granted permission to drive trucks between 9am and 4pm.
Grewal remains subject to a curfew outside those hours and is banned from carrying passengers.
The charges relate to a crash in Lynwood in Perth’s south-east in the early hours of March 28.
Police allege Grewal was driving a silver Toyota Kluger along Nicholson Road when the vehicle left the road and struck a tree about 3:40am.
A seven-month-old baby later died in hospital, while a 32-year-old woman and a three-year-old child were seriously injured.
Police further allege Grewal had been working for extended hours prior to the crash and may have briefly fallen asleep at the wheel. It is alleged dashcam footage shows the driver nodding off multiple times before the incident.
He has been charged with one count of dangerous driving occasioning death and two counts of dangerous driving occasioning bodily harm.
During the bail application, Grewal’s lawyers argued he had taken breaks, was not under the influence of drugs or alcohol, and was not speeding at the time of the crash.
An Uber spokesperson said the company has fatigue management systems that require drivers to take an eight-hour break after 12 cumulative hours on the app, but it is understood Grewal was also working a second job as a freight driver.
Grewal has not entered any pleas and declined to comment as he left court. He is due to face Perth Magistrates Court on August 11.
