They warned that failure to comply could result in arrest by Australian authorities or detention if he returned to India.

In the weeks after his death, the boys’ mother was hospitalised for acute mental health care and later travelled to India to be supported by her sisters, leaving the brothers without a parent able to care for them in Australia.

Lodging an appeal allows applicants to remain in Australia while their case is under review — sometimes for years — even when their claims ultimately fail.

Investigators had worked intensively to assess whether the accused acted alone and whether there was any ongoing risk to the community.
